AMBICA TOUR’S FREQUENT TRAVELER CARD
Terms and Conditions.
Effective 15th August 2007.
1. Membership in the AMBICA TOURS Frequent Traveler program (AMBICA TOURS Frequent Traveler) is subject to Terms and Conditions and all rules, terms and conditions of the participating Program Partners which may be amended from time to time. AMBICA TOUR’S Frequent Traveler Terms and Conditions are available on the AMBICA TOURS website at ambicatours.com or by calling 9860082786 / 02532580006.
2. AMBICA TOURS Frequent Traveler is an award program for frequent travelers.
3. Membership of AMBICA TOURS Frequent Traveler, now is open only to individuals.
Membership is not yet open to families, groups, companies, trusts, partnerships, government departments, agencies.
4. Membership is offered at the discretion of AMBICA TOURS.
AMBICA TOURS has the right to accept or reject any application for Membership.
5. New Members may, before they use their Membership and within ONE weeks of receiving their Membership number, notify AMBICA TOURS that they no longer wish to be a Member. AMBICA TOURS will then cancel their Membership and refund any joining or other fees paid for that Membership. Otherwise, Membership is non-refundable and is not transferable.
6. AMBICA TOURS may, in its absolute discretion, provide activity statements to
Members.
7. A Statement Request Fee (see the Fee Schedule) will be charged whenever a Member requests an activity statement to be sent in paper form. Activity information is available without charge at ambicatours.com
8. Each Member is responsible for ensuring that Points are properly credited to their account. AMBICA TOURS reserves the right to require proof of earning from the Member, including copies of ticket coupons and/or original boarding passes from flights claimed to have been flown or copies of receipts or similar documentation, for example, car rental agreement, hotel voucher or hotel bill.
9. The AMBICA TOURS Frequent Traveler membership card and number provide
identification. The card is not a payment card. The card and membership number are for use only by the member and are not transferable. Members are responsible for the security of their own cards, membership numbers and PINs and for keeping their contact details up to date.
10. AMBICA TOURS reserves the right at all times, subject to applicable laws,
to make any changes (whether material or otherwise) to AMBICA TOURS Frequent Traveler, the Terms and Conditions, the Awards or Benefits offered, and the Fee Schedule, including:
(a) changes to:
the ways in which Points are earned and redeemed;
Point earning and redeeming rates;
limitations on the number of Award Flights or Free Holidays and Upgrades redeemable on particular flights / Free Holidays.
Awards or Benefits, including the continued availability of Awards or Benefits;
Award restrictions or conditions;
ticketing procedures;
ticketing and service charges; and
the expiry of accrued Points;
(d) changes to AMBICA TOUR’S products, services, Holiday Packages or flights.
11. If in AMBICA TOUR’SÕ reasonable opinion a Member has committed a material breach of any of the Terms and Conditions or has failed to pay any money owed to AMBICA TOURS by the due date, whether intentionally or otherwise, then AMBICA TOUR’S may, at its sole discretion and without any liability, do any one or more of the following:
(a) suspend or terminate the Member’s Membership and/or the right of the Member to use the Card;
(b) reverse or cancel the Member’s Points or any part thereof; or (c) cancel or refuse to honour any Awards (including Free Holiday Package / ticketed Award Flights), Benefits or both, that have been redeemed by or provided to the Member.
12. Membership will terminate automatically on the death of a Member. Points earned but not yet redeemed or transferred prior to the death of the Member will be cancelled. AMBICA TOUR’S will close the Member’s account on notification of the Members death. AMBICA TOURS will not be liable for any loss or damage whatsoever suffered by any person as a result of such cancellation.
13. Members will be personally liable for any and all costs, taxes, GST, charges, claims or liabilities of whatever nature (including all ticket taxes) arising from the provision or availability of any Awards or Benefits whether these are provided by AMBICA TOURS,
14. Point earning and redeeming restrictions may apply to certain fare types and flights. Members should check at ambicatours.com or contact the concern person.
15. Award Flights / Free Holiday Packages are subject to capacity controls and availability is limited. AMBICA TOURS, the number of Award Flight seats or free Holiday Package available to Members at their absolute discretion. The number of Award Flight seats or free Holiday packages available will depend on the flight, Hotels, date, season, destination and commercial demand.
16. It is a condition of Membership that a Member consents and authorises AMBICA TOURS to provide the information on their application form and other information that they provide to AMBICA TOURS,
(a) AMBICA TOURS providing services, including the awarding of Points to Members;
(b) AMBICA TOURS improving customer service, including by means of research, marketing, product development and planning;
(c) AMBICA TOURS marketing its products or services or the products or services
of its partners; and
(d)any third party providing services to AMBICA TOURS and Members in connection with the administration of AMBICA TOURS Frequent Traveler.
17. On request by a Member and to the extent permitted or required by law, AMBICA TOURS will provide that Member with access to and the ability to correct their personal information held by AMBICA TOURS. Only the Member named on the account will be entitled to access their Membership information. However, AMBICA TOURS does comply with validly served and executed court orders and subpoenas and cooperates with investigations by State, Police, Court and Income Tax Dept. Under those circumstances or where otherwise required by law, a Members account information may be shared with others with or without that Member’s knowledge or consent.
Tax considerations.
AMBICA TOURS recommends that Members consult their accountant or tax adviser to ensure that they understand possible tax For the Free Gifts / Prizes / Free Holidays / Free Air Tickets. Like Service tax / Income Tax / Other Taxes implications, if any, related to Membership and Benefits.
